Terms of Service
These Terms of Service (“Terms”) govern your access to and use of WP FloorMap — the WP FloorMap WordPress plugin and block theme, the wpfloormap.com service and the related APIs (together, the “Service”) — provided by Foreword Development LLC (“Foreword”, “we”, “us”, “our”).
WP FloorMap builds complete property websites from your Engrain SightMap® data, using a combination of deterministic and AI-assisted processes, and then supplements that data with a wide range of property-management and marketing features — including floor plans, availability, pricing, amenities, neighborhood maps, a guided Setup Wizard, AI-assisted site copy and a “Schedule a Tour” booking system.
These Terms have two parts. Part A applies to subscribers — the property managers, owners and operators who license and install the Software. Part B applies to site visitors who use features such as “Schedule a Tour” on a website built with WP FloorMap. By using the Service in either capacity, you agree to the part of these Terms that applies to you. If you do not agree, do not use the Service.
Part A — Subscriber & License Terms
This part applies to you if you license, install or configure the WP FloorMap plugin or theme (a “Subscriber”).
1. Definitions
- Software — the WP FloorMap WordPress plugin and the WP FloorMap block theme, including all updates we provide.
- Service — the Software together with the wpfloormap.com hosted service, license validation, software updates and the APIs that power premium features.
- Subscription — a paid plan (Plugin, Launch or Studio, with an optional managed-hosting add-on) that grants access to the Service.
- License Key — the credential we issue that activates the Software for the domain or domains covered by your Subscription.
- Visitor — an end user who interacts with a website you operate using the Software.
2. License Grant
Subject to your compliance with these Terms and an active Subscription, Foreword grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable license to install and use the Software on the WordPress website or websites covered by your Subscription, solely for operating your own property marketing sites.
The Software is licensed, not sold. Foreword and its licensors retain all right, title and interest in and to the Software. You receive only the rights expressly granted here.
3. License Restrictions
Except as expressly permitted by these Terms or by our prior written permission, you may NOT:
- copy, reproduce or republish the Software;
- modify, adapt, translate or create derivative works from the Software, except for configuration and customization of your own site through the interfaces we provide;
- distribute, sublicense, sell, rent, lease, lend or otherwise make the Software available to any third party, except under a written agreement as described in Section 4;
- use the Software to build, train or operate a product or service that competes with WP FloorMap;
- reverse engineer, decompile or disassemble the Software, or attempt to derive its source code, except to the extent applicable law expressly permits despite this restriction;
- remove, obscure or alter any copyright, trademark, license-key or other proprietary notice; or
- circumvent, disable or interfere with the license-key validation, usage metering or any security or access-control feature of the Service.
These restrictions mirror, and are in addition to, the proprietary license that accompanies the Software (LICENSE.txt). Any use of the Software outside the scope of these Terms automatically terminates the license granted in Section 2.
4. Resellers and Integration Partners
These Terms grant a license to use the Software for your own property sites only. They do not grant any right to resell, white-label, bundle, redistribute or sublicense the Software or the Service, or to hold yourself out as a WP FloorMap reseller, agency or integration partner.
Foreword may, at its sole discretion, enter into separate reseller, agency or integration-partner arrangements. Any such activity — including reselling the Service to clients, white-labeling it or integrating it with another product — is permitted only to the extent expressly authorized in a written agreement signed by Foreword Development LLC, and is subject to the terms of that agreement. Absent a signed agreement, the restrictions in Section 3 apply in full.
5. Subscriptions, Plans and Billing
- The Service is offered on tiered plans (Plugin, Launch and Studio) with a monthly or annual billing cycle, and an optional managed-hosting add-on. Premium features — including the block theme, the premium Setup Wizard steps, AI-assisted copy generation, geocoding and the tour scheduler — require a Launch or Studio Subscription.
- Payments are processed by Stripe. By subscribing, you authorize us to charge your chosen payment method through Stripe for the applicable fees, including taxes.
- Subscriptions renew automatically at the end of each billing cycle until cancelled. You may cancel at any time; cancellation takes effect at the end of the current paid period.
- We may change plan features or fees. Price changes apply from your next renewal and we will give reasonable advance notice.
- Except where required by law or expressly stated at purchase, fees are non-refundable. Failure to pay may result in suspension or termination of the Service.
6. Hosting (Optional)
If you choose our optional managed-hosting add-on, website hosting is provided through WP Engine (WP Engine, Inc.) unless we note otherwise. WP Engine’s own uptime, service-level and acceptable-use policies apply to the hosting environment.
Foreword does not make any server or uptime guarantee beyond that provided by WP Engine, and is not responsible or liable for downtime, data loss, performance or other issues attributable to the hosting provider or to factors outside our control. Hosting fees, where applicable, are billed as part of your Subscription under Section 5.
7. License Keys and Activation
- Each Subscription issues a License Key bound to your registered domain or domains. The Software periodically validates the key with our servers to confirm an active Subscription and to deliver updates.
- Premium features depend on a valid key and an active Subscription. If your Subscription lapses or is terminated, or the key is revoked for breach, premium features and the block theme stop functioning.
- Your own WordPress content (pages, posts, images and settings) remains on your server and remains yours, subject to the restrictions in Section 3.
8. Acceptable Use
You agree not to use the Service to: resell or redistribute the Software except as permitted under Section 4; circumvent license checks or usage limits; place excessive or abusive load on our APIs; infringe the rights of others; or violate any applicable law or the terms of the integrated third-party services (including Engrain SightMap, Google and Microsoft). You are responsible for all activity that occurs under your Subscription and License Key.
9. Your Content and Visitor Data
You are responsible for the content you publish with the Software and for your lawful use of any property and resident data. With respect to personal data collected from your site Visitors (for example through the “Schedule a Tour” or contact forms), you are the data controller and Foreword acts as your data processor. You must maintain your own privacy notice, establish a lawful basis for processing and obtain any consents required by law. Our handling of personal data is described in the Privacy Policy.
Importing content from an existing website (Launch and Studio)
The Setup Wizard may offer to read a website address that you provide for your property (an “Existing Site”) and use its content to help build your new site — for example to pre-fill amenities, contact details and opening hours, and to give our AI copy generator additional context about your property. This feature is optional; you are never required to use it.
WP FloorMap reads the Existing Site only to extract specific factual information — such as the names of amenities, leasing-office contact details and opening hours — and the readable text of its pages, which is used purely as context for our AI to write fresh, original copy for your new site, together with your logo if you choose to import it. WP FloorMap does not copy, reproduce, mirror or reuse the source code, HTML, design, layout, templates, stylesheets, fonts, photography, artwork or any other creative or visual asset of the Existing Site (other than your logo). Your new site is built entirely from WP FloorMap’s own theme and templates and is not a clone, copy or derivative of the Existing Site’s design.
If you choose to use it, you represent and warrant that you own, or otherwise hold all rights, licenses and permissions necessary to read, copy, adapt and republish the content of the Existing Site for this purpose, and you authorize Foreword to access and fetch the Existing Site and its publicly accessible pages on your behalf in order to provide the feature. You are solely responsible for the content that is imported — principally your logo and any copy or descriptive text — and for ensuring it does not infringe the rights of any third party that you do not have the right to reuse.
Foreword reads the Existing Site only at your request and only to provide this feature. We do not warrant that any import is complete, accurate or error-free, and you remain responsible for reviewing, editing and approving all imported content before it is published on your site. To the fullest extent permitted by law, Foreword is not responsible or liable for any claim arising from content imported from an Existing Site at your direction, and your indemnity in Section 16 applies to such content.
10. Intellectual Property
The Software, including all of its source code, design, user interfaces, block patterns, prompt templates, documentation and the WP FloorMap and Foreword Development names, logos and brand, is the exclusive property of Foreword Development LLC and is protected by copyright, trademark and other laws. Your Subscription grants a license, not a transfer of ownership.
You retain ownership of your own content — your logos, text, images and property data — and of the marketing copy the Service generates for your own website, which you may use freely on that site. You grant Foreword a limited license to host, process and display that content as needed to provide the Service. Any feedback or suggestions you provide may be used by Foreword without restriction or obligation to you.
Studio custom development
Where your Studio plan includes custom development hours, the custom work product Foreword creates specifically for you within those contracted hours — for example bespoke templates, patterns or code written to your specification — belongs to you, the Client, upon full payment for the work.
This does not transfer ownership of the Software itself or of Foreword’s pre-existing or general-purpose tools, libraries, frameworks, methods and know-how (“Background IP”), which remain the exclusive property of Foreword. To the extent any Background IP is incorporated into a custom deliverable, Foreword grants you a perpetual, non-exclusive license to use that Background IP solely as part of the deliverable on your own site.
11. Third-Party Services
The Software integrates with third-party services, including Engrain SightMap (required for property data), and optionally Google Calendar and Microsoft Outlook for tour scheduling. These services are provided by their respective owners under their own terms and privacy policies. Foreword is not responsible for the availability, content or practices of any third-party service, and a change to a third-party service may affect related features.
12. Service Availability and Updates
The Service — including its APIs, plugin and theme — is provided on an “as available” basis and may occasionally be interrupted, delayed, degraded or affected by maintenance, updates or factors outside our control. We design updates to be backwards compatible unless we note otherwise, and we aim to keep the Service reliable, but we do not guarantee that it will be uninterrupted, error-free or always backwards compatible.
To the fullest extent permitted by law, Foreword is not responsible or economically liable for any loss or prejudice — including site downtime, site or product bugs, lost data, lost business or other damages — arising from any interruption, update, defect or unavailability of the Service. Your sole remedy for dissatisfaction with the Service is to stop using it and cancel your Subscription.
13. Accuracy of Information
WP FloorMap displays property information — including floor plans, availability, pricing and amenities — sourced in real time from Engrain SightMap and the operator’s property-management system, and it can generate marketing copy with AI assistance. This information may be incomplete, out of date or inexact.
Foreword does not warrant the accuracy, completeness or timeliness of any information shown on sites built with WP FloorMap or otherwise produced using our products, and is not responsible for any reliance on that information. Operators are responsible for reviewing and correcting the content shown on their own sites.
14. Warranty Disclaimer
THE SERVICE AND SOFTWARE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free or secure, or that it will meet your requirements.
15. Limitation of Liability
- To the maximum extent permitted by law, Foreword shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to the Service.
- Foreword’s total liability for any claim arising out of or related to the Service shall not exceed the amount you paid to Foreword for the Subscription in the twelve (12) months preceding the event giving rise to the claim.
- The Software provides scheduling and marketing tools only. Foreword is not a party to, and is not responsible for, any lease, tour, transaction or other agreement between you and a Visitor.
16. Indemnification
You agree to indemnify and hold harmless Foreword Development LLC and its officers and personnel from any claim, demand, loss or expense (including reasonable legal fees) arising out of your content, your use of the Service in breach of these Terms or your violation of any law or the rights of a third party.
17. Term, Suspension and Termination
- These Terms apply for as long as you use the Service or hold a Subscription.
- We may suspend or terminate your access for non-payment, for breach of these Terms or where required to protect the Service or comply with law. Where practical, we will give notice and an opportunity to cure.
- On termination, your license ends, your License Key may be revoked and premium features and the theme cease to function. Sections that by their nature should survive (including License Restrictions, Resellers and Integration Partners, Intellectual Property, Service Availability and Updates, Accuracy of Information, Warranty Disclaimer, Limitation of Liability, Indemnification and Governing Law) survive termination.
18. Governing Law (Subscribers)
For Subscribers, these Terms are governed by and construed in accordance with the laws of the State of New Jersey, USA, without regard to its conflict-of-laws rules. You and Foreword submit to the exclusive jurisdiction of the state and federal courts located in New Jersey for any dispute arising out of or related to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.
Part B — Site Visitor Terms
This part applies to you if you use an interactive feature — such as “Schedule a Tour”, saved favorites or a contact form — on a property website built with WP FloorMap (a “Visitor”). The property operator, not Foreword, runs that website and is responsible for it.
19. Tour Booking and Confirmation
- The “Schedule a Tour” feature lets you request a property tour at an available date and time. A request is confirmed once you receive a confirmation email with a confirmation code.
- Confirmation is subject to real-time availability. If your requested slot is no longer available when you submit, you will be asked to choose another time.
- A confirmed booking is an appointment request between you and the property, not a binding contract for a lease, purchase or any other agreement.
20. Cancellation
- You may cancel a booking at any time before the scheduled tour using the cancellation feature with your confirmation code and email address.
- Cancelled bookings are removed from the property team’s calendar. As a courtesy, please cancel at least 24 hours in advance.
21. Visitor Obligations
By submitting a form, you confirm that:
- the information you provide (name, email, phone number) is accurate and belongs to you;
- you are at least 16 years of age;
- you will not use the feature for fraudulent, abusive or spam purposes; and
- you understand the property may contact you by email, SMS or phone about your visit.
22. Communication Consent
By submitting the “Schedule a Tour” form, you consent to receive communications solely in relation to the tour you scheduled: a confirmation email with your booking details and code; SMS reminders and notifications about your tour; and email or phone contact from the property team about your visit. Your information is used for no other purpose. You will not be added to any marketing list.
Opting Out of SMS Messages
You may opt out of SMS at any time by replying STOP to any message you receive. After you reply STOP, you will no longer receive SMS for your tour. Standard message and data rates from your mobile carrier may apply.
23. Availability and Limitations
- Tour availability is set by the property and may change at any time without notice.
- We make reasonable efforts to keep the booking system available and accurate but do not guarantee uninterrupted or error-free operation.
- The property may reschedule or cancel a tour due to unforeseen circumstances and will make reasonable efforts to notify you.
24. Visitor Data Protection
Personal data you submit is collected and processed in accordance with our Privacy Policy. For Visitor data, the property operator is the data controller and Foreword acts as its processor. For questions about how a particular site uses your data, contact the property operator. Visitor data and any related dispute are governed by the law of the operator’s own jurisdiction.
General
25. Changes to These Terms
We may modify these Terms from time to time. The “Last updated” date above reflects the latest revision. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
26. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
